3. Acceptable use
You agree not to use Orbix Central to:
- Violate any applicable law or regulation.
- Infringe the intellectual property or other rights of others.
- Transmit malicious code, interfere with the service, or attempt to gain unauthorised access.
- Store or transmit unlawful, harmful, or infringing content.

4. Your content
You retain ownership of the business data and content you enter into Orbix Central (“your content”). You grant us a limited licence to process, store and display your content solely to provide the service to you. You are responsible for your content and warrant that you have the right to use and store it.
5. AI-generated content
Orbix Central includes optional AI-powered features (for example, summaries, drafted replies and rewrites) that assist you in working with your content. AI-generated output is provided for convenience only and may be incomplete, inaccurate or unsuitable for any particular purpose — it is not a substitute for your own judgement or professional advice. You are solely responsible for reviewing, verifying and deciding whether to use any AI-generated output, and for the consequences of using it. As between us, you remain responsible for your content (as set out in section 4) regardless of whether AI tools were used to draft or process it.
6. Intellectual property
The Orbix Central platform, including its software, design, logos and branding, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute or create derivative works of the Orbix Central software or branding, except as expressly permitted.
7. Australian Consumer Law
Nothing in these Terms limits any rights you may have under the Australian Consumer Law (ACL). To the extent permitted by law, and subject to the ACL, our services are provided “as is” and we make no warranties regarding their availability, accuracy or fitness for a particular purpose. If a guarantee under the ACL applies and cannot be excluded, your remedies are those provided under the ACL.
8. Limitation of liability
To the maximum extent permitted by law, and subject to the ACL, our total liability arising out of or in connection with these Terms or the service will not exceed the amount you paid us for the service in the 12 months preceding the claim. We are not liable for indirect, incidental, special or consequential damages, or for loss of profits, data or goodwill.
9. Indemnity
To the maximum extent permitted by law, you agree to indemnify and hold Orbix Central and its personnel harmless from and against any claims, damages, losses, liabilities and reasonable expenses arising out of or in connection with: (a) your breach of these Terms; (b) your content, including any claim that it infringes the rights of a third party; or (c) your misuse of the service or your account. This indemnity does not apply to the extent a claim arises from our negligence or wilful misconduct, and it does not remove any right you have under the ACL.
10. Payment, cancellation and refunds
If the service is provided for a subscription fee, the fee and billing period will be stated when you choose a plan. Unless otherwise agreed in writing, fees are payable in advance and are non-refundable except where required by law. Subject to your rights under the ACL, you may cancel your subscription at any time by contacting us using the details below; cancellation takes effect at the end of the then-current billing period and you will have access to the service until that time. Where a consumer guarantee under the ACL applies and the service fails to meet it, you are entitled to a remedy, which may include a refund, repair or replacement as applicable.
11. Termination
You may stop using Orbix Central and close your account at any time. We may suspend or terminate your access if you breach these Terms, or where required by law. On termination, your content may be deleted in accordance with our data retention practices and applicable law.
12. Third-party services
Orbix Central may integrate with or reference third-party services (such as identity, security and payment providers). Your use of those services is subject to their own terms and policies, which we encourage you to review.
